Terms of Use

These Terms of Use (the “Terms”) set out the conditions for using kichi-jp.com (the “Site”), operated by KICHI LLC (KICHI合同会社, “we” or “us”). By using the Site, you (the “User”) are deemed to agree to these Terms.

Article 1 (About the Site)

The Site provides information about the following homes operated by us and accepts booking/inquiry requests:

• Kichi Inn Horikiri (registered under the Private Lodging Business Act, Notification No. M130064416): whole-house short stays, bookable on Airbnb or by direct request to us
• Monthly rentals: a 1st-floor apartment in Higashi-Nippori, and share houses in Higashi-Nippori and Nishi-Sugamo (fixed-term leases, 定期借家契約)
• A planned home in Oji-Kamiya

Article 2 (Requests and Formation of Contracts)

1. Submitting the form on the Site is a booking/inquiry request only. Submission alone does not create a lodging or lease contract.
2. We will normally reply within 24 hours with availability and price. A contract is formed only when we confirm the booking in writing or by email.
3. The Site does not currently accept payment.
4. Short stays booked on Airbnb are governed by Airbnb’s terms and policies.
5. Monthly rental rooms are governed by the separate fixed-term lease contract, which prevails over these Terms.

Article 3 (Estimates)

Prices shown on the Site are estimates and are not binding. The final price is as stated in our reply and the confirmed conditions.

Article 3-2 (Cancelling or changing a direct booking)

For direct bookings of Kichi Inn Horikiri confirmed by us (not bookings made on Airbnb), the following applies. Days are counted back from the check-in date in Japan time, and percentages are of the total confirmed price (cleaning included).

1. Flexible plan (pay after we confirm): free cancellation (full refund) until 30 days before check-in; 50% charged from 29 to 7 days before; 100% from 6 days before, or for a no-show.
2. Prepaid plan (pay in full when booking, discounted): if you cancel until 14 days before check-in, we refund 50%; from 13 days before, or for a no-show, there is no refund. Until 14 days before, you may change your dates once free of charge to available dates (any price difference is settled).
3. If we cannot host you for reasons on our side, or if we judge that your stay is not possible because of an earthquake, typhoon or other disaster, suspension of public transport, or a request by the government or local authorities, we give a full refund or change your dates free of charge, whichever plan you chose.
4. Refunds are, in principle, made by the same method as your payment.

Article 4 (Information on the Site)

We strive to keep the information and photos on the Site accurate, but we do not guarantee that they are complete or up to date. Photos may include illustrative images, and furniture, equipment or surroundings may differ from the actual property. Content may change without notice.

Article 5 (Prohibited Acts)

When using the Site, Users must not:

• submit false information or impersonate another person;
• send spam, unsolicited commercial messages or other nuisance submissions;
• use the Site for purposes that violate laws or public order and morals; or
• interfere with the operation of the Site (including unauthorized access or placing excessive load on it).

Article 6 (Intellectual Property)

Copyrights and other intellectual property rights in the text, photos, logos, design and other content of the Site belong to us or their rightful owners. Copying, republishing or modifying them beyond private use without our permission is prohibited.

Article 7 (Disclaimer and Limitation of Liability)

1. Except in cases of our willful misconduct or gross negligence, we are not liable for damage arising from interruption, suspension or malfunction of the Site or errors in its content.
2. Where we are liable for damages, except in cases of our willful misconduct or gross negligence, our liability is limited to direct and ordinary damage actually incurred by the User.
3. If any provision of these Terms is held invalid under the Consumer Contract Act or other laws of Japan, that provision applies only to the extent permitted by such laws.

Article 8 (External Links)

The Site contains links to Airbnb and other external websites. Those sites are governed by their operators’ own terms, and we are not responsible for their content or practices.

Article 9 (Personal Information)

We handle Users’ personal information in accordance with our separate Privacy Policy.

Article 10 (Changes to These Terms)

We may amend these Terms as necessary. Amended Terms take effect when posted on the Site.

Article 11 (Governing Law and Jurisdiction)

These Terms are governed by and construed in accordance with the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute between us and a User relating to the Site.

Article 12 (Language)

The Japanese version of these Terms is the official text. The English and Vietnamese versions are translations for reference; if there is any inconsistency, the Japanese version prevails.
